August Primary 2026 Absentee Ballot Guidance

Under Wis. Stat. § 6.86(5), when a voter returns a spoiled or damaged ballot, the municipal clerk shall issue a new ballot to the voter. Since 2022, ballot spoiling has been heavily litigated.
On July 9, 2026, the Wisconsin Elections Commission (WEC):
“Clarified that a voter may receive up to two replacement absentee ballots for a total of three (which includes the original).” and
“Determined that if a voter returns their voted ballot and later changes their mind about who they would like to vote for or because the candidate they originally voted for has dropped out of the race, this does not constitute an ‘accident or mistake.’” The ballot cannot be spoiled and reissued for any reason.”
What this means: As gubernatorial candidates continue to drop out (or re-enter) the race, concerns are growing that voters may wait to return their ballots. It is important that we are clear about the options voters have to return their ballots, to ensure every vote is counted.
Returning Absentee Ballots:
You are able to return your absentee ballot via mail, drop box, returning in person to your city clerk prior to election day or at your polling place on Election Day
Mail: If you plan to vote by mail, you should return your ballot in the mail no later than July 31st. Ballots must be received by 8 pm on Election Day to be counted.
Drop Box: Please contact your city clerk to find out if your municipality has a drop box
In-Person to Clerk (Pre-Election Day): Drop off at your city clerk prior to election day
Polling Place Drop Off: If you are still have your ballot on Election Day, you must return the ballot to your polling place
